ORC § 4733.161
| Unauthorized practice. Effective: November 24, 1995 Latest Legislation: House Bill 231 - 121st General Assembly PDF: Download Authenticated PDF (A) Notwithstanding any other provision of this chapter, any person who performs labor or who provides services pursuant to a construction contract may offer or provide engineering services in connection with the person's own labor or services if all of the following apply: (1) The engineering services are provided and performed by an engineer registered under this chapter or by a firm holding a certificate of authorization granted pursuant to this chapter through either direct employment or independent contract with the person contracting with the owner and offering the services. (2) The engineering services are offered by the person who intends to perform the actual construction of an improvement to real property as part of a design-build contract. (3) The contractor, the engineer registered under this chapter, or the firm holding a certificate of authorization granted pursuant to this chapter meets the requirements of section 153.70 of the Revised Code when design-build services are provided to a public authority as defined in section 153.65 of the Revised Code. (B) Except as otherwise provided in this section, no person shall offer or engage in the practice of engineering without a certificate of authorization for any construction contract that is to be constructed by another person, or hold himself or herself out to the public as engaging in the practice of engineering or as providing engineering services without a certificate of authorization. | Lien on commercial real estate. Effective: September 30, 2021 Latest Legislation: Senate Bill 49 - 134th General Assembly PDF: Download Authenticated PDF (A)(1) A professional engineer or professional surveyor who enters into a written contract for services to be provided with regard to any interest in commercial real estate has a lien on that interest. (2) The lien shall be effective only if the contract for services is in writing and is signed by the professional engineer or professional surveyor and the owner of the interest in commercial real estate. (B)(1) Only the professional engineer or professional surveyor named in the contract shall have a lien pursuant to this section. (2) A lien is not available to any employee, agent, or independent contractor of the professional engineer or professional surveyor. (C) The amount of the lien shall be limited to the amount due to the professional engineer or professional surveyor pursuant to the contract. (D) The lien shall be effective only against the interest in commercial real estate that is the subject of the contract. (E) All valid and recorded mechanic's liens arising pursuant to Chapter 1311. of the Revised Code, regardless of recordation date, and all previously recorded mortgages and liens, including judgment liens, take priority over a professional engineer or professional surveyor's lien. | Real estate broker definitions. Effective: September 30, 2025 Latest Legislation: House Bill 96 - 136th General Assembly PDF: Download Authenticated PDF As used in this chapter: (A) "Real estate broker" includes any person, partnership, association, limited liability company, limited liability partnership, or corporation, foreign or domestic, who for another, whether pursuant to a power of attorney or otherwise, and who for a fee, commission, or other valuable consideration, or with the intention, or in the expectation, or upon the promise of receiving or collecting a fee, commission, or other valuable consideration does any of the following: (1) Sells, exchanges, purchases, rents, or leases, or negotiates the sale, exchange, purchase, rental, or leasing of any real estate; (2) Offers, attempts, or agrees to negotiate the sale, exchange, purchase, rental, or leasing of any real estate; (3) Lists, or offers, attempts, or agrees to list, or auctions, or offers, attempts, or agrees to auction, any real estate; (4) Buys or offers to buy, sells or offers to sell, or otherwise deals in options on real estate; (5) Operates, manages, or rents, or offers or attempts to operate, manage, or rent, other than as custodian, caretaker, or janitor, any building or portions of buildings to the public as tenants; (6) Advertises or holds self out as engaged in the business of selling, exchanging, purchasing, renting, or leasing real estate; (7) Directs or assists in the procuring of prospects or the negotiation of any transaction, other than mortgage financing, which does or is calculated to result in the sale, exchange, leasing, or renting of any real estate; (8) Is engaged in the business of charging an advance fee or contracting for collection of a fee in connection with any contract whereby the broker undertakes primarily to promote the sale, exchange, purchase, rental, or leasing of real estate through its listing in a publication issued primarily for such purpose, or for referral of information concerning such real estate to brokers, or both, except that this division does not apply to a publisher of listings or compilations of sales of real estate by their owners; (9) Collects rental information for purposes of referring prospective tenants to rental units or locations of such units and charges the prospective tenants a fee. (B) "Real estate" includes leaseholds as well as any and every interest or estate in land situated in this state, whether corporeal or incorporeal, whether freehold or nonfreehold, and the improvements on the land, but does not include cemetery interment rights. (C) "Real estate salesperson" means any person associated with a licensed real estate broker to do or to deal in any acts or transactions set out or comprehended by the definition of a real estate broker, for compensation or otherwise. | Construction industry licensing board definitions. (B) "Contractor" means any individual or contracting company that satisfies both of the following: (1) Has responsibility for the means, method, and manner of construction, improvement, renovation, repair, or maintenance on a construction project with respect to one or more trades and who offers, identifies, advertises, or otherwise holds out or represents that the individual or contracting company is permitted or qualified to perform or have responsibility for the means, method, and manner of construction, improvement, renovation, repair, or maintenance with respect to one or more trades on a construction project; (2) Does either of the following: (a) Performs construction, improvement, or renovation on a construction project with respect to the individual's or contracting company's trade; (b) Employs tradespersons who perform construction, improvement, or renovation on a construction project with respect to the individual's or contracting company's trades. (D) "Licensed trade" means a trade performed by a heating, ventilating, and air conditioning contractor, a refrigeration contractor, an electrical contractor, a plumbing contractor, or a hydronics contractor. (E) "Tradesperson" means any individual who is employed by a contractor and who engages in construction, improvement, renovation, repair, or maintenance of buildings or structures without assuming responsibility for the means, method, or manner of that construction, improvement, renovation, repair, or maintenance. (F) "Construction project" means a construction project involving a building or structure subject to Chapter 3781. of the Revised Code and the rules adopted under that chapter, but not an industrialized unit or a residential building as defined in section 3781.06 of the Revised Code. (G) "Training agency" means an entity approved by the administrative section of the board to provide continuing education courses. Section
Ohio Rev. Code § 4740.01
As used in this chapter:
(A) "License" means a license the Ohio construction industry licensing board issues to an individual as a heating, ventilating, and air conditioning contractor, refrigeration contractor, electrical contractor, plumbing contractor, or hydronics contractor.
(B) "Contractor" means any individual or contracting company that satisfies both of the following:
(1) Has responsibility for the means, method, and manner of construction, improvement, renovation, repair, or maintenance on a construction project with respect to one or more trades and who offers, identifies, advertises, or otherwise holds out or represents that the individual or contracting company is permitted or qualified to perform or have responsibility for the means, method, and manner of construction, improvement, renovation, repair, or maintenance with respect to one or more trades on a construction project;
(2) Does either of the following:
(a) Performs construction, improvement, or renovation on a construction project with respect to the individual's or contracting company's trade;
(b) Employs tradespersons who perform construction, improvement, or renovation on a construction project with respect to the individual's or contracting company's trades.
(C) "Contracting company" means a company in the construction industry working on construction projects.
(D) "Licensed trade" means a trade performed by a heating, ventilating, and air conditioning contractor, a refrigeration contractor, an electrical contractor, a plumbing contractor, or a hydronics contractor.
(E) "Tradesperson" means any individual who is employed by a contractor and who engages in construction, improvement, renovation, repair, or maintenance of buildings or structures without assuming responsibility for the means, method, or manner of that construction, improvement, renovation, repair, or maintenance.
(F) "Construction project" means a construction project involving a building or structure subject to Chapter 3781 of the Revised Code and the rules adopted under that chapter, but not an industrialized unit or a residential building as defined in section 3781.06 of the Revised Code.
(G) "Training agency" means an entity approved by the administrative section of the board to provide continuing education courses.
ORC § 4740.02
| Ohio construction industry licensing board. Effective: September 17, 2014 Latest Legislation: Senate Bill 78 - 130th General Assembly PDF: Download Authenticated PDF (A) There is hereby created within the department of commerce, the Ohio construction industry licensing board, consisting of seventeen residents of this state. The board shall have an administrative section and three specialty sections: a plumbing and hydronics section, an electrical section, and a heating, ventilating, air conditioning, and refrigeration section. The director of commerce shall appoint all members of the board. The director or the director's designee shall serve as a member of the administrative section and the director shall appoint to the section to represent the public, one member who is not a member of any group certified by any section of the board. Each section, other than the administrative section, shall annually elect a member of its section to serve a one-year term on the administrative section. (B) The plumbing and hydronics section consists of five members, one of whom is a plumbing inspector employed by the department of commerce, a municipal corporation, or a health district, two of whom are plumbing contractors who have no affiliation with any union representing plumbers, and two of whom are plumbing contractors who are signatories to agreements with unions representing plumbers. The plumbing and hydronics section has primary responsibility for the licensure of plumbing contractors and hydronics contractors. (C) The electrical section consists of five members, one of whom is an electrical inspector employed by the department of commerce, a municipal corporation, or a county, two of whom are electrical contractors who have no affiliation with any union representing electricians, and two of whom are electrical contractors who are signatories to agreements with unions representing electricians. The electrical section has primary responsibility for the licensure of electrical contractors. (D) The heating, ventilating, air conditioning, and refrigeration section consists of five members, one of whom is a heating, ventilating, air conditioning, and refrigeration inspector employed by either the department of commerce or a municipal corporation; two of whom are heating, ventilating, and air conditioning contractors or refrigeration contractors who have no affiliation with any union representing heating, ventilating, and air conditioning tradespersons or refrigeration tradespersons; and two of whom are heating, ventilating, and air conditioning contractors or refrigeration contractors who are signatories to agreements with unions representing heating, ventilating, and air conditioning tradespersons or refrigeration tradespersons. The heating, ventilating, air conditioning, and refrigeration section has primary responsibility for the licensure of heating, ventilating, and air conditioning contractors and refrigeration contractors. Ohio Rev. Code § 4740.02
There is created within the department of commerce the Ohio construction industry licensing board, consisting of seventeen residents of this state. The board has an administrative section and three specialty sections: plumbing and hydronics, electrical, and heating, ventilating, air conditioning, and refrigeration. The director of commerce appoints all board members. The plumbing and hydronics section consists of five members including a plumbing inspector, two non-union plumbing contractors, and two union-affiliated plumbing contractors, with primary responsibility for licensure of plumbing and hydronics contractors. The electrical section consists of five members including an electrical inspector, two non-union electrical contractors, and two union-affiliated electrical contractors, with primary responsibility for licensure of electrical contractors. The heating, ventilating, air conditioning, and refrigeration section consists of five members including an inspector, two non-union contractors, and two union-affiliated contractors, with primary responsibility for licensure of these contractors. Initial appointments were made within ninety days after July 31, 1992. Terms of office are three years. Before taking office, each member takes the oath required by Section 7 of Article XV, Ohio Constitution. Members receive per diem and expenses for board duties. The director may remove any appointed member for malfeasance, misfeasance, or nonfeasance. Board membership does not constitute public office or employment. The board must provide adequate advance notice before meetings.

| Administrative section of board - powers and duties. Effective: September 17, 2014 Latest Legislation: Senate Bill 78 - 130th General Assembly PDF: Download Authenticated PDF The administrative section of the Ohio construction industry licensing board is responsible for the administration of this chapter and shall do all of the following: (A) Schedule the contractor examinations each of the other sections of the board directs. Each type of examination shall be held at least four times per year. (B) Select and contract with one or more persons to do all of the following relative to the examinations: (1) Prepare, administer, score, and maintain the confidentiality of the examinations; (2) Be responsible for all the expenses required to fulfill division (B)(1) of this section; (3) Charge an applicant a fee in an amount the administrative section of the board authorizes for administering the examination. (C) Issue and renew licenses as follows: (1) Issue a license to any individual who the appropriate specialty section of the board determines is qualified pursuant to section
Ohio Rev. Code § 4740.04
The administrative section of the Ohio construction industry licensing board is responsible for the administration of this chapter and shall do all of the following:
(A) Schedule the contractor examinations each of the other sections of the board directs. Each type of examination shall be held at least four times per year.
(B) Select and contract with one or more persons to prepare, administer, score, and maintain the confidentiality of the examinations; be responsible for all the expenses required; charge an applicant a fee in an amount the administrative section of the board authorizes for administering the examination.
(C) Issue and renew licenses: issue a license to any individual who the appropriate specialty section of the board determines is qualified pursuant to section 4740.06 and has attained the required examination score. Each license shall include the contractor's name, license number, expiration date, and the name of the contracting company associated with the individual. Renew licenses for individuals who meet the renewal requirements of section 4740.06.
(D) Make an annual written report to the director of commerce on proceedings had by or before the board for the previous year and make an annual statement of all money received and expended by the board during the year.
(E) Keep a record containing the name, address, the date on which the board issues or renews a license to, and the license number of, every heating, ventilating, and air conditioning contractor, refrigeration contractor, electrical contractor, plumbing contractor, and hydronics contractor issued a license pursuant to this chapter.
(F) Regulate a contractor's use and display of a license issued pursuant to this chapter and of any information contained in that license.
(G) Adopt rules in accordance with Chapter 119 as necessary to properly discharge the administrative section's duties under this chapter, including application procedures for examinations, specifications for continuing education requirements for license renewal, and requirements for criminal records checks.
(H) Adopt any continuing education curriculum as the other sections of the board establish or approve.
(I) Keep a record of its proceedings and do all things necessary to carry out this chapter.
Ohio Rev. Code § 4740.05
Each specialty section of the Ohio construction industry licensing board, other than the administrative section, shall do all of the following:
(A) Adopt rules in accordance with Chapter 119 that are limited to: criteria for evaluating qualifications of an individual; criteria for deciding whether to issue, renew, suspend, revoke, or refuse to issue or renew a license; the determinations and approvals under the reciprocity provision of section 4740.08; criteria for continuing education courses; a requirement that any training agency seeking approval to provide continuing education courses submit the required information at least thirty days but not more than one year prior to the proposed offering date; a prohibition against any training agency providing a course unless approved not more than one year prior; a list of disqualifying offenses pursuant to sections 9.79, 4740.06, 4740.10, and 4776.10.
(B) Investigate allegations in reference to violations of this chapter and determine by rule a procedure to conduct investigations and hearings.
(C) Maintain a record of its proceedings.
(D) Grant approval to a training agency to offer continuing education courses.
(E) As required, do all things necessary to carry out this chapter.
(F) Establish or approve a continuing education curriculum for license renewal for each class of contractors. No curriculum may require more than five hours per year in specific course requirements. No contractor may be required to take more than ten hours per year in continuing education courses.
(G) Design the examination for the type of contractor the specialty section licenses to determine an applicant's competence to perform that type of contracting.
ORC § 4740.06
of the Revised Code to hold a license and has attained, within the twelve months preceding the individual's application for licensure, a score on the examination that the appropriate specialty section authorizes for the licensed trade. (a) Each license shall include the contractor's name, license number, expiration date, and the name of the contracting company associated with the individual, as applicable. (b) Each license issued to an individual who holds more than one valid license shall contain the same license number and expiration date as the original license issued to that individual. Ohio Rev. Code § 4740.06
(A) Any individual who applies for a license shall file a written application with the appropriate specialty section of the Ohio construction industry licensing board, accompanied with the application fee as determined pursuant to section 4740.09. The application shall be on the form the section prescribes.
(B) To qualify to take an examination, an individual shall: be at least eighteen years of age; be a United States citizen or legal alien; either have been a tradesperson in the type of licensed trade for not less than five years immediately prior to the application date, be a currently registered engineer in this state with three years of business experience in the construction industry, or have other experience acceptable to the appropriate specialty section; maintain contractor's liability insurance; and not have violated this chapter, obtained a license through fraud, or engaged in fraud or deception in business conduct.
(C) For an individual who holds an out-of-state occupational license that is substantially similar, to qualify to take an examination, the individual shall provide proof of authorizations for construction, tax returns reflecting income earned, and proof that the contracting company is either licensed as a foreign corporation or registered as a foreign LLC in Ohio.
(D) For an individual actively engaged in activities in the service of the uniformed services that are substantially similar to the licensed activities, to qualify the individual shall provide proof of at least three of five years of active engagement.
(F) When an applicant meets qualifications and passes the required examination, the specialty section shall authorize the administrative section to license the applicant within ninety days.
(H) All licenses expire annually on the same date. An individual holding a valid license may renew without reexamination by submitting an application and renewal fee with proof of continuing education compliance.
(L) No specialty section shall preclude license renewal due to past criminal activity or moral character interpretation. The section may refuse to issue a license based on conviction in accordance with section 9.79.
Ohio Rev. Code § 4740.07
The administrative section of the Ohio construction industry licensing board issues and renews licenses under this chapter in the name of individuals meeting section 4740.06 requirements. Individuals applying for licenses may request assignment to their employing contracting company. When assigned, the license states the individual's name and position. Unassigned licenses become inactive. During company assignment, no duplicate license may be issued to that individual for the same contracting type. If an individual ceases association with a company, both parties must notify the board; the assignment becomes invalid 90 days after death, company change completion, or an agreed earlier date. Work conducted under assigned licenses is deemed under the named individual's personal supervision, making them liable for violations. Individuals assigning licenses must actively engage in that contracting type and remain available for consultation. No license may be simultaneously assigned to multiple companies, and individuals cannot assign the same license type to different companies until the original assignment becomes invalid.
ORC § 4740.09

The applicant shall provide information satisfactory to the section showing that the applicant meets the requirements of division (B), (C), or (D) of this section. (B) To qualify to take an examination, an individual shall: (1) Be at least eighteen years of age; (2) Be a United States citizen or legal alien who produces valid documentation to demonstrate the individual is a legal resident of the United States; (3) Either have been a tradesperson in the type of licensed trade for which the application is filed for not less than five years immediately prior to the date the application is filed, be a currently registered engineer in this state with three years of business experience in the construction industry in the trade for which the engineer is applying to take an examination, or have other experience acceptable to the appropriate specialty section of the board; (4) Maintain contractor's liability insurance in an amount the appropriate specialty section of the board determines and only in one contracting company name; (5) Not have done any of the following: (a) Violated this chapter or any rule adopted pursuant to it; (b) Obtained or renewed a license issued pursuant to this chapter, or any order, ruling, or authorization of the board or a section of the board by fraud, misrepresentation, or deception; (c) Engaged in fraud, misrepresentation, or deception in the conduct of business. (C) For an individual who holds an out-of-state occupational license, as defined in section 4796.01 of the Revised Code, that is substantially similar to the license for which the individual is applying under this chapter, to qualify to take an examination, an individual shall: (1) Provide proof that the individual was issued at least five authorizations for construction, erection, equipment, alteration, or addition of any building by an authority with responsibility for enforcing building regulations in the jurisdiction where the individual holds the out-of-state occupational license; (2) Provide at least one tax return that reflects income earned for services provided under the individual's out-of-state occupational license; (3) Provide proof that the contracting company with whom the individual is employed in the jurisdiction where the individual holds the out-of-state occupational license is either of the following: (a) Licensed as a foreign corporation under section 1703.04 of the Revised Code and has designated an agent in this state in accordance with section 1703.041 of the Revised Code; (b) Registered as a foreign limited liability company under section 1706.511 of the Revised Code and has designated an agent in this state in accordance with section 1706.09 of the Revised Code. (4) Meet the requirements described in divisions (B)(1), (2), (4), and (5) of this section. (D)(1) For an individual who has been actively engaged in activities in the service of the uniformed services,

No curriculum may require more than five hours per year in specific course requirements. No contractor may be required to take more than ten hours per year in continuing education courses. ORC § 4740.12
| Local regulation - regulation by other state agencies. Effective: March 30, 2007 Latest Legislation: House Bill 487 - 126th General Assembly PDF: Download Authenticated PDF (A) No political subdivision, district, or agency of the state may adopt an ordinance or rule that requires contractor registration and the assessment of a registration or license fee unless that ordinance or rule also requires any contractor who registers and pays the registration or license fee to be licensed in the contractor's trade pursuant to this chapter. (B) Except as provided in division (A) of this section, nothing in this chapter shall be construed to limit the operation of any statute or rule of this state or any ordinance or rule of any political subdivision, district, or agency of the state that does either of the following: (1) Regulates the installation, repair, maintenance, or alteration of plumbing systems, hydronics systems, electrical systems, heating, ventilating, and air conditioning systems, or refrigeration systems; (2) Requires the registration and assessment of a registration or license fee of tradespersons who perform heating, ventilating, and air conditioning, refrigeration, electrical, plumbing, or hydronics construction, improvement, renovation, repair, or maintenance. Ohio Rev. Code § 4740.12
Division (A) establishes that political subdivisions cannot require contractor registration and fees unless registrants are also licensed in their trade per this chapter. Division (B) preserves existing state and local regulations governing installation, repair, maintenance, or alteration of plumbing, hydronics, electrical, HVAC, and refrigeration systems, as well as registration requirements for tradespersons in these fields.
ORC § 4740.13
| Contractor operating without license. Effective: September 17, 2014 Latest Legislation: Senate Bill 78 - 130th General Assembly PDF: Download Authenticated PDF (A) No person shall act as or claim to be a type of contractor that this chapter licenses unless that person holds or has been assigned a license issued pursuant to this chapter for the type of contractor that person is acting as or claiming to be. (B) Upon the request of the appropriate specialty section of the Ohio construction industry licensing board, the attorney general may bring a civil action for appropriate relief, including but not limited to a temporary restraining order or permanent injunction in the court of common pleas of the county where the unlicensed person resides or is acting as or claiming to be a licensed contractor. (C) A contractor licensed under this chapter may install, service, and maintain the related or interfaced control wiring for equipment and devices related to their specific license, on the condition that the control wiring is less than twenty-five volts. (D) A person is not an electrical contractor subject to licensure under this chapter for work that is limited to the construction, improvement, renovation, repair, testing, or maintenance of the following systems using less than fifty volts of electricity: fire alarm or burglar alarm, cabling, tele-data sound, communication, and landscape lighting and irrigation. Ohio Rev. Code § 4740.13
This provision establishes licensing requirements and restrictions for contractors. It prohibits individuals from operating as or claiming to be a licensed contractor type without proper authorization. The Attorney General may pursue civil remedies including injunctions against unlicensed operators. Licensed contractors may install control wiring under 25 volts for their specialty. Certain low-voltage systems, such as fire alarm, burglar alarm, cabling, tele-data sound, communication, and landscape lighting using less than 50 volts, fall outside electrical contractor licensure requirements.

| Lease of employees. | Residential construction advisory committee - recommendation of residential building code. Effective: December 19, 2016 Latest Legislation: House Bill 471 - 131st General Assembly PDF: Download Authenticated PDF (A) There is hereby created within the department of commerce the residential construction advisory committee consisting of nine persons the director of commerce appoints. The advisory committee shall be made up of the following members: (1) Three shall be general contractors who have recognized ability and experience in the construction of residential buildings. (2) Two shall be building officials who have experience administering and enforcing a residential building code. (3) One, chosen from a list of three names the Ohio fire chief's association submits, shall be from the fire service certified as a fire safety inspector who has at least ten years of experience enforcing fire or building codes. (4) One shall be a residential contractor who has recognized ability and experience in the remodeling and construction of residential buildings. (5) One shall be an architect registered pursuant to Chapter 4703. of the Revised Code, with recognized ability and experience in the architecture of residential buildings. (6) One, chosen from a list of three names the Ohio municipal league submits to the director, shall be a mayor of a municipal corporation in which the Ohio residential building code is being enforced in the municipal corporation by a certified building department. (B) Terms of office shall be for three years, with each term ending on the date three years after the date of appointment. Each member shall hold office from the date of appointment until the end of the term for which the member was appointed. Vacancies shall be filled in the manner provided for initial appointments. Any member appointed to fill a vacancy in an unexpired term shall hold office for the remainder of that term. (C) The advisory committee shall do all of the following: (1) Recommend to the board of building standards a building code for residential buildings. The committee shall recommend a code that it may model on a residential building code a national model code organization issues, with adaptations necessary to implement the code in this state. If the board of building standards decides not to adopt a code the committee recommends, the committee shall revise the code and resubmit it until the board adopts a code the committee recommends as the state residential building code; (2) Advise the board regarding the establishment of standards for certification of building officials who enforce the state residential building code; (3) Assist the board in providing information and guidance to residential contractors and building officials who enforce the state residential building code; (4) Advise the board regarding the interpretation of the state residential building code; (5) Provide other assistance the committee considers necessary; (6) Provid

Section 4764.02 does not apply to any person described as follows if the person is acting within the scope of practice of the person's respective profession: (A) A person employed by or whose services are retained by the state or a political subdivision for enforcing building codes; (B) A person holding a valid certificate to practice architecture issued under Chapter 4703; (C) A person registered as a professional engineer under Chapter 4733; (D) A heating, ventilating, and air conditioning contractor, refrigeration contractor, electrical contractor, plumbing contractor, or hydronics contractor who is licensed under Chapter 4740 or section 3781.102 or who is licensed or registered under section 715.27; (E) A real estate broker, salesperson, foreign real estate dealer, or foreign real estate salesperson licensed under Chapter 4735; (F) A real estate appraiser licensed under Chapter 4763; (G) A public insurance adjuster who holds a valid certificate of authority issued under Chapter 3951 or an employee or representative of an insurer conducting an inspection for purposes related to the business of insurance; (H) A commercial applicator of pesticide licensed under Chapter 921.
